Auto-Renewal Clause

Contract language that automatically renews your processing agreement for another full term unless you give written notice within a narrow window. The most common reason merchants get stuck.

Most multi-year processing contracts contain an auto-renewal clause: 'This agreement renews for successive 12-month (or 36-month) terms unless either party gives written notice 60–90 days before the end of the current term'. If you miss that window, you're locked into another full term — with the same ETF if you try to leave.

What to do today: search your current contract for 'auto-renew', 'evergreen', or 'renewal'. Note the notice window and set a calendar reminder for 120 days before expiration. When sending notice, use certified mail with delivery confirmation — verbal notice is universally rejected.

New contracts: ask for the auto-renewal clause to be removed entirely, or for the renewal term to be month-to-month after the initial period.
